Terms of Use

This document is the agreement between you and the provider of Jibiyar. By creating an account or using the app you accept these terms. If you do not agree with any part of them, please do not use the service. The Persian text is the governing version of this agreement.

1. Definitions

In this document the following terms have the meanings given below:

  • Service: the Jibiyar mobile and desktop apps, the jibiyar.com website, and all related services.
  • Provider: Khared Hoosh Yar (private joint-stock company), registration number -, national ID -, the legal entity providing the service, referred to here as "we".
  • User: the person who creates an account or uses the service, referred to here as "you".
  • Account: the account created and authenticated with your mobile number or email address.
  • User content: any data you enter or that is extracted from your speech — including the amount, description, category, date and notes of your transactions.
  • Subscription: a time-limited plan that unlocks the service's AI features.
  • Data message: as defined in the Iranian E-Commerce Act of 1382 (2003).

2. Acceptance and legal capacity

Using the service constitutes full and unconditional acceptance of these terms and of the Privacy Policy. The two documents complement each other and should be read together.

Under Article 190 of the Iranian Civil Code a contracting party must have legal capacity. By accepting these terms you confirm that you are at least 18 years old, or that you use the service with the permission and under the supervision of your legal guardian, who has accepted these terms on your behalf.

This contract is concluded electronically and is valid and binding between the parties under Article 10 of the Civil Code and the E-Commerce Act.

3. What the service is — and what Jibiyar is not

Jibiyar is a personal tool for recording, categorising and reviewing your expenses and income. Its purpose is to help you see your own spending patterns, and nothing beyond that.

For the avoidance of doubt, Jibiyar is not any of the following and does not hold itself out as such:

  • Not a financial, investment or tax adviser. No output of the service — including its reports and savings suggestions — constitutes financial, investment or legal advice.
  • Not official accounting software. Its outputs are not accounting records, statutory ledgers or tax documents, and are not designed for submission to tax, banking or judicial authorities.
  • Not a credit institution, bank, payment gateway or financial services provider. Jibiyar does not connect to your bank account, does not move money, and performs no real financial transactions.
  • Not a substitute for professional advice. For any significant financial decision, consult a qualified professional.

4. Your account and authentication

You sign in with your mobile number or email address and a one-time code. Keeping control of your SIM card, email address and device — and therefore any use made of your account — is your own responsibility.

You undertake to provide accurate information that belongs to you. Creating an account with someone else's number, or transferring your account to a third party, breaches these terms.

If you believe someone has gained access to your account, sign out on all devices immediately and tell us through one of the channels in the "Contact us" section. We are not responsible for unauthorised use of the account before you notify us.

5. Subscriptions, pricing and payment

Entering income and expenses by hand, viewing your transactions, categories and reports, and exporting your data are free for every user. The AI features — voice entry, the chat assistant and the savings advisor — require an active subscription, because they are processed on our servers and cost real money to run.

Each plan's price is stated clearly in Toman before purchase. There are no hidden charges and no amount is ever taken without your knowledge and consent.

In-app payment is not currently available. You can claim the free plan directly in the app; paid plans are activated manually on your account after you arrange payment with support.

Subscriptions do not auto-renew and no recurring amount is charged. When a term ends, access to the AI features stops, but your data remains and the free parts of the service stay available.

We may change plan prices. A price change has no effect on an active, already-paid subscription and applies only to later purchases.

6. Right of withdrawal and refunds

Under Article 37 of the Iranian E-Commerce Act, in a distance transaction you have at least seven working days to withdraw without penalty and without giving a reason. Under Iranian law this right cannot be waived, even by agreement to the contrary in a contract.

However, under the implementing regulation of Articles 38 and 42 of the E-Commerce Act (approved 1383/10/09), services whose performance has begun with the consumer's agreement before the end of the seven working days are excluded from the right of withdrawal. Activating a subscription constitutes your express request for the service to begin immediately; accordingly, once you have activated it and started using the AI features, the right of withdrawal no longer applies to the portion consumed.

If you withdraw before using any subscription feature, the full amount paid is refunded. Under Article 38 of the same Act, the refund is made within the statutory period.

To exercise the right of withdrawal, simply tell us through any channel in the "Contact us" section.

7. Permitted use and prohibited conduct

The service is for your personal, non-commercial use. Large-scale commercial use requires a separate agreement with us. The following are expressly prohibited:

  • Unauthorised access to the service, to other people's accounts, to our servers or to our data.
  • Reverse engineering, decompiling, extracting models, or attempting to circumvent subscription or authentication controls.
  • Automated data extraction (scraping), use of bots, or any other automated means of bulk access.
  • Placing abnormal load on the service, denial-of-service attacks, or anything that degrades the service's stability for others.
  • Uploading criminal or offensive content, or content contrary to the laws of the Islamic Republic of Iran.
  • Using the service for money laundering, tax evasion or any other criminal activity.

8. Intellectual property

All rights in the service — including its code, design, user interface, the Jibiyar name and mark, and the models and algorithms it uses — belong to the provider and are protected by the Iranian Act on Protection of the Rights of Computer Software Authors of 1379 (2000) and other intellectual property law.

Using the service grants you a personal, limited, non-exclusive and non-transferable licence to use it, and transfers no ownership to you.

9. Your data and content

The transactions and information you record in Jibiyar belong to you. We do not become their owner.

You grant us a limited licence, strictly to the extent needed to provide the service, to store, process, synchronise and display that data back to you. Full details are in the Privacy Policy.

You can export your data as CSV or JSON at any time. This is free for every user and does not require an active subscription.

10. AI accuracy and your responsibility for correctness

Speech recognition, intent extraction and automatic categorisation are statistical and inherently fallible technologies. They may misread an amount, date, category or description — particularly in a noisy environment, with a strong accent, or in an ambiguous sentence.

Reviewing and confirming the correctness of your data is your responsibility. Check any figure or report before relying on it. The app lets you edit or delete any transaction.

Savings suggestions are calculated purely from your own past spending patterns, are provided for information only, and are in no sense financial or investment advice.

11. Availability and changes to the service

We work to keep the service available, but we give no guarantee of continuous, uninterrupted or error-free availability. The service may be temporarily unavailable for maintenance, updates or technical reasons.

We may change, limit or remove features. If we discontinue the service entirely we will notify you beforehand and allow a reasonable period for you to export your data.

12. Disclaimer of warranties

The service is provided "as is" and "as available".

To the maximum extent permitted by law we give no warranty, express or implied, as to: the correctness, accuracy or completeness of data and reports; the service's fitness for your particular purpose; error-free or uninterrupted operation; or the correctness of speech recognition and automatic categorisation results.

13. Limitation of liability

To the maximum extent permitted by the laws of the Islamic Republic of Iran, the provider is not liable for:

  • Indirect, consequential or incidental damages, loss of profit, or loss of opportunity.
  • Any financial, investment, tax or personal decision taken on the basis of the service's data or reports.
  • Loss, corruption or inaccuracy of data, including as a result of speech-recognition or auto-categorisation errors.
  • Internet or mobile-network outages, network access restrictions, or any factor outside our control.
  • The behaviour of app stores, your device's operating system, or third-party software.
  • Unauthorised use of your account resulting from your SIM card, email or device coming into someone else's hands.

14. Cap on liability

In all cases and on any basis, the provider's total liability to you will not exceed the total amount you paid for a subscription in the three months preceding the claim. If you have paid nothing, the service was provided free of charge and the provider bears no liability on that basis.

Important exception: nothing in this section or in sections 12 and 13 excludes or limits liability for wilful misconduct or fraud, or any liability that cannot be excluded under mandatory Iranian law. If a competent authority finds any of these provisions unenforceable, that provision is modified to the minimum extent necessary and the remainder stays in force.

15. Indemnity

If your breach of these terms, or your unlawful use of the service, causes loss to the provider or to a third party, or gives rise to a claim, you undertake to compensate that loss and the associated legal costs.

16. Suspension and termination

You may stop using the service at any time, or request deletion of your account from Settings. Export your data first.

We may temporarily suspend or permanently block your account for breach of these terms, misuse of the service, or where required by law. Except where delay is not possible, we will notify you beforehand.

17. Force majeure

The provider is not liable for delay or failure to perform caused by circumstances beyond its reasonable control, including but not limited to: nationwide or regional internet outages, regulatory restrictions, international sanctions and restricted access to foreign infrastructure, natural disasters, war, strikes, power cuts, and failures at hosting or telecommunications providers.

18. Changes to these terms

We may update these terms. The current version is always available in the app and at jibiyar.com/terms, and the date of the last update appears at the top of this document.

For a material change we will notify you in the app before it takes effect and ask you to accept the terms again. Continuing to use the service after notice means you accept the new version. If you do not accept it, you can export your data and close your account.

19. Governing law and disputes

This agreement is governed by the laws of the Islamic Republic of Iran, including the E-Commerce Act of 1382 (2003), the Consumer Protection Act of 1388 (2009), and the Computer Crimes Act of 1388 (2009).

In the event of a dispute the parties will first try to resolve it by negotiation through the service's support channels. If no agreement is reached within thirty days, the competent courts of Mashhad will have jurisdiction.

This clause does not limit your right to bring a consumer complaint before the competent regulatory bodies, including the Consumer and Producer Protection Organisation and the Iranian e-commerce complaints system.

20. General provisions

Severability: if any part of these terms is found void or unenforceable by a competent authority, the remaining parts stay in force.

No waiver: not exercising a right immediately does not mean we waive it.

Entire agreement: these terms together with the Privacy Policy constitute the entire agreement between you and the provider and supersede any prior oral or written understanding.

Governing language: in the event of any discrepancy between the Persian version and this English translation, the Persian text prevails.
